Like many, we would like to help where we can and, whilst we have no useful medical or caring skills we can at least give people the peace of mind that, should they fall ill or succumb to coronavirus, their financial affairs are in order and their loved ones will be looked after.

So, with immediate effect, we are offering a free and quick will writing service for frontline workers. To be clear, there is no catch. This is a completely free service with no financial obligations whatsoever. It is the best way in which we can use our skills to make a practical contribution to the nation’s key workers at this critical time. It is the least we can do to say thank you.

THINGS TO CONSIDER BEFORE WRITING YOUR WILL

Writing your Will is a daunting prospect for many people and on that often gets 'put off', as a result. Unfortunately, it's also one of the most important things you should address in life, particularly, once you get married, have children or start to accumulate assets of any value.

We've found that people often procrastinate over writing their Will because they don't really understand exactly what's involved or how to go about it, so, here are a few things you need to consider that will help you get started. Thinking about the basics:

You need to appoint Executors. These are the people that will carry out the instructions in your Will. You can appoint up to four Executors but it's wise to appoint at least two. Executors can also be beneficiaries in your Will.
If you have children under the age of 18, you'll need to appoint Guardians for them. This allows you to decide who should be responsible for your children's welfare. Guardians may also be Executors.
Who do you want the residue of your estate to go to? The residue of your estate is everything left after payments of all debts, taxes and expenses. You don't need to itemise the residue, you can simply decide what proportion each beneficiary is to receive, if you are naming more than one.
It is important to note, that a Will only disposes of your solely owned assets. Any assets you own jointly, will always pass to the surviving joint owner and does not form part of your will for distribution.
What would happen if? This is a question you should ask often. For example, what would happen if a beneficiary were to pass away before you do? What would happen if you re-married?

What Do I Need To Do?

We have prepared a very basic form for you to complete which we will turn into a legally binding will. Once you have completed it, we will send it back to you by email as a PDF for you to check, print and sign. You will need two witnesses to sign it. Once complete it will be legally valid.

Signing and Witnessing Instructions during COVID-19

Your Will must be executed by you ('the testator') in the following manner to ensure that it is effective and that your estate is dealt with as you wish.

The execution of your Will involves you, together with, two independent witnesses. Your Will must be executed in the following manner to ensure that it is effective.

Please read and follow the simple checklist below when signing and witnessing your Will:

DO:

Have TWO independent witnesses present at all times when signing your Will. Contact a friend or neighbour to witness by watching you through a window sign your documents. Ask the witnesses to stand back the required 2m's. After you have signed, safely leave the documents on the doorstep or windowsill. You will then need to watch your witnesses sign the documents where indicated. Ask your witnesses to leave the documents on the doorstep or windowsill and leave or stand the required 2m distance.
- Witnesses do not need to read the Will or know its contents, although they should be told what it is. They are simply witnessing your signature and acknowledging that you have signed the Will freely, and on the basis that the contents of the Will have been understood and approved by you.
- Witnesses must be over 18 years old (do not let a minor witness your Will).
- Witnesses need to be independent and should not be related to you or anyone mentioned in your Will, either by blood, marriage or civil partnership, however witnesses may be related to each other.
In the presence of your two witnesses and in the space provided:
- Write the date clearly in full, including the year e.g. 1^st January 2020 on the final page.
- Sign with your usual signature on each page where indicated whilst your witnesses watch.
- In your presence, ask your witnesses to add their usual signatures on the last page together with their name, address, phone number and occupation.
- If you do need to correct your Will in any way, make sure you do so before it is signed and the amendment must be initialled by you and both your witnesses.

All Wills have to be signed and witnessed correctly to make them effective. Failure to do so will make your Will invalid.

DO NOT:

Ask a beneficiary, nor the spouse/registered civil partner of a beneficiary to witness the Will, as any benefit or interest to which they are entitled within the Will, will be lost.
Use correction fluid on your Will if you make a mistake.
Fasten anything to your Will e.g. staples, paperclips.

After signing, please return the documents to Heritage Will Writing in order for us to arrange secure storage of the documents, alternatively if you are self-storing your signed will documents, please email a copy or a photo to info@heritagewillwriting.co.uk to ensure your wills have been correctly signed. Please remember, it is important for your signed Will to be stored somewhere safe. It is also a good idea to let your executors know where it is being kept.
