Executor Stress

Being chosen to dispose of a loved one’s money and possessions after they die is an honour and a privilege. It’s a task most of us will undertake at some point in our lives.

However, an executor of a will may have to negotiate a legal and emotional minefield at a very stressful time.

Bear in mind when picking suitable executors that they must be of sound mind and aged 18 or over. Being trustworthy and reliable probably goes without saying but it’s advisable that they live close to you, can work together, have a good chance of outliving you and that you ask their permission.

It’s also best to name one professional, like a solicitor, to ensure the correct legal steps are followed as an executor must register the death; assess debts, liabilities, assets and money; complete probate and tax forms; pay inheritance tax and all bills; prepare accounts; distribute the estate and deal with any claims.

And be aware that executors can be held legally responsible if things are not done properly.
